Agreements related to the disappearance of minors


–Hague Convention of October 25, 1980 on the Civil Aspects of International Child Abduction: the removal of a child by one of the parents abroad is considered unlawful if it is committed in violation of custody rights (in France, parental authority) recognized by the other parent, or any other institution or organization, by the law of the State in which the minor lived before his disappearance.


– Article 18, paragraph 1 of the International Convention on the Rights of the Child: states that the parties will make every effort to ensure recognition of the principle that both parents have common obligations in the upbringing and development of the child. Parents or, where applicable, legal representatives, have the primary responsibility for the upbringing and development of the child. The best interests of the child will be the fundamental concern.
